为什么民族习惯法、村规民约等民间法现象难以成为当前法学研究的主要关注对象？其法学理论层面的原因是，我们一直在用建基于国家法现象的法学理论或国家法法哲学在审视整个世界的法现象。本书建构的“民间法哲学”，试图唤醒从整体之法的现象视角来观照自身的广义法哲学观，在建构或重构“民间法”“场域公共秩序”等核心概念的基础上，勾勒出民间法的基石法益、基石法理、国内国际维度疆界，及其“法治中国”担当等主题内容，确立起民间法跟国家法相对位的理论主体地位。
